Chapter 7 Discharge
Your discharge is the completion of the bankruptcy process. You can expect your discharge after your meeting with the trustee. The average time is 3-4 months.
Chapter 13 Discharge
Your discharge is the completion of the bankruptcy process. You will receive a discharge once all the payments have been made into your case. This could be a period of 3 – 5 years depending on your bankruptcy plan. Once the final payment has been received by the Trustee, He will make the final disbursements (done once a month). You can expect your discharge about 45 days after the final disbursement has been made. If your case is funded by a wage order the Trustee will send an order to stop it after his audit of your case. Any funds received after the final payment will be refunded to you by the Trustee.
Rebuilding Your Credit
After you file bankruptcy, you will often receive offers to obtain credit at high interest rates. We suggest that you go to a financial institution and obtain a secured credit card. A secured card is where you place a small amount of money in a savings account and that amount is your credit limit. Make small purchases with this card (ex. Gas, groceries) and pay off the full balance each month. As you do this, you will begin to improve your credit rating and receive a higher credit limit.
Cleaning your Credit Report
After you receive your discharge from the court, send a copy of your petition and discharge to each of the credit bureaus. The bureaus have 30 days to make any corrections after they receive the information. If you want a copy of your corrected report, send a letter and the fee for the copy. If you have been denied credit in the last 60 days, send a copy of the denial letter and you will receive a free copy of your report.
